Rubbish Removal Chelsea Service Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Removal Chelsea provides rubbish removal, waste collection and related services to customers. By booking a service, you confirm that you have read, understood and agree to be bound by these Terms and Conditions.

1. Definitions

1.1 In these Terms and Conditions the following expressions have the meanings set out below:

Customer means any individual, business, organisation or other party that books or receives services from Rubbish Removal Chelsea.

Services means any rubbish removal, waste collection, bulky waste clearance, household or commercial clearance, loading, transportation or disposal services provided by Rubbish Removal Chelsea.

Waste means any items, materials, rubbish, junk, debris or goods presented by the Customer for collection and removal as part of the Services.

Site means the address or location where the Services are to be provided.

2. Scope of Services

2.1 We provide rubbish removal and waste collection services for domestic and commercial customers within our operational area. Services may include clearance of general household waste, garden waste, office waste, construction debris and bulky items, subject to these Terms and Conditions and to applicable waste regulations.

2.2 We reserve the right to refuse to remove any items that we reasonably believe to be hazardous, unlawful to handle, unsafe to transport, inadequately described at the time of booking, or not in compliance with waste legislation or licensing conditions.

2.3 Our obligation is to remove Waste from the Site and arrange for its lawful transportation, treatment, recycling or disposal. We do not undertake structural work, demolition, disconnection of utilities, or specialist cleaning unless expressly agreed in writing as part of a separate agreement.

3. Booking Process

3.1 Bookings may be made by telephone, email or through our online enquiry systems where available. A booking is not confirmed until we have accepted your request and provided a booking confirmation with the agreed date, time window, and indicative price or charging structure.

3.2 You must provide accurate information at the time of booking, including the Site address, type and approximate volume or weight of Waste, location of items on the Site, access conditions, parking arrangements, and any potential hazards. This information is used to estimate the time, resources and charges required.

3.3 Our quotations are based on the information you provide. If on arrival the Waste differs substantially in volume, type or access from the description provided, we may adjust the price, revise the service offer, or decline to proceed if it would be unsafe, unlawful or impractical to do so.

3.4 The person making the booking warrants that they are the owner of the Waste or are authorised by the owner to arrange removal of the Waste and to enter into a contract with us on these Terms and Conditions.

4. Access and Parking

4.1 You are responsible for ensuring safe, reasonable and lawful access to the Site for our team and vehicle. This includes arranging any necessary permits, parking permissions, gate codes, building access or lift access in advance.

4.2 Any parking fees, congestion charges or penalty charges incurred as a direct result of performing the Services, and which could not reasonably have been avoided, may be added to your invoice.

4.3 If we are unable to gain access to the Site at the agreed time due to circumstances within your control, we may charge a waiting fee, an attendance fee or a cancellation/aborted visit fee as set out in our pricing information.

5. Customer Obligations

5.1 You must ensure that the Site is safe for our team to access and work in, and that the Waste is reasonably accessible for removal. This includes, where possible, grouping Waste items together and clearing access routes.

5.2 You must not present for collection any items classed as hazardous or special waste, such as asbestos, clinical waste, certain chemicals, solvents, oils, gases, explosives, or any other materials that we are not licensed or equipped to handle, unless we have explicitly agreed to do so in writing and in compliance with relevant regulations.

5.3 You must notify us in advance of any items that may be sharp, heavy, fragile, contaminated or otherwise pose a risk to health and safety so that appropriate precautions can be taken.

5.4 You warrant that none of the Waste presented for collection is stolen and that you have full right and authority to arrange its removal. You agree to indemnify us against any claim or loss arising from a breach of this warranty.

6. Pricing and Payments

6.1 Our charges are generally based on the volume and type of Waste collected, the labour involved, access conditions, and any additional services requested. We may provide guide prices in advance, but the final price will be confirmed on Site once we have inspected the Waste and assessed the work required.

6.2 All prices are quoted in pounds sterling and may be subject to value added tax where applicable. Any applicable taxes will be clearly stated at the time of quoting or invoicing.

6.3 Unless otherwise agreed, payment is due in full upon completion of the Services on the day of collection. We may accept payment by cash, card or bank transfer, subject to availability of payment methods at the time of service.

6.4 For business customers or larger projects, we may agree alternative payment terms, including deposits or payment on account. Any such terms must be agreed in writing prior to commencement of the Services.

6.5 If payment is not received when due, we reserve the right to charge interest on outstanding sums at the statutory rate and to recover any reasonable costs incurred in pursuing late payments, including legal and debt recovery costs.

7. Cancellations, Rescheduling and Aborted Visits

7.1 You may cancel or reschedule a booking by contacting us within our stated office hours. We request as much notice as possible so that we can reallocate resources efficiently.

7.2 If you cancel or reschedule with sufficient notice, as defined in our current cancellation policy, no cancellation fee will normally be charged. If you cancel or reschedule at short notice, we may apply a cancellation fee or charge an attendance fee to cover costs incurred.

7.3 If our team attends the Site at the agreed time and is unable to complete the Services due to circumstances within your control, such as lack of access, absence of an authorised person, unsafe conditions or refusal to proceed, this may be treated as an aborted visit and charged accordingly.

7.4 We may cancel or reschedule a booking in the event of operational issues, severe weather, vehicle breakdown, staff illness, safety concerns or other circumstances beyond our reasonable control. In such cases we will seek to notify you as soon as reasonably practicable and rearrange the Service. We will not be liable for any indirect loss or consequential loss arising from such cancellations or delays.

8. Performance of Services

8.1 We will exercise reasonable skill and care in providing the Services and will make reasonable efforts to arrive within the agreed time window. Any arrival times are estimates and are not guaranteed unless expressly stated otherwise.

8.2 Our team will load and remove Waste from the Site as agreed. We reserve the right to decide the order in which items are removed and to make decisions on the number of team members and vehicles required.

8.3 Once Waste has been loaded into our vehicle, it becomes our responsibility and you will no longer have any claim to the items removed.

8.4 We will take reasonable care not to cause damage to property when providing the Services. However, you should move or protect any fragile items, floor coverings, pathways or fixtures which may be at risk during the removal process, as far as is reasonably practicable.

9. Waste Regulations and Environmental Compliance

9.1 We operate in accordance with applicable waste management legislation and guidance in the United Kingdom. This includes duties relating to the collection, transfer, transportation and disposal of controlled waste.

9.2 We will arrange for Waste collected from you to be taken to licensed facilities for reuse, recycling, recovery or disposal as appropriate. We aim to divert Waste from landfill where reasonably practicable, but no specific recycling or recovery rates are guaranteed unless expressly agreed in writing.

9.3 Where required, we will issue or arrange appropriate documentation evidencing the lawful transfer of Waste, such as waste transfer notes, in line with relevant regulations.

9.4 You acknowledge your duty of care in relation to Waste and agree to cooperate with any reasonable requests for information needed to comply with legal or regulatory requirements.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter for which it would be unlawful to limit or exclude liability.

10.2 Subject to clause 10.1, our total liability to you in respect of any claim arising out of or in connection with the Services or these Terms and Conditions, whether in contract, tort, breach of statutory duty or otherwise, shall not exceed the total fees paid or payable by you for the specific Service giving rise to the claim.

10.3 We shall not be liable for any indirect, consequential or economic loss, including loss of profit, loss of business, loss of data, loss of opportunity or loss of goodwill, arising out of or in connection with the provision of the Services.

10.4 We will not be liable for any damage to property or possessions where such damage results from pre-existing defects or weaknesses, fair wear and tear, inherent risks associated with moving large or heavy items, or your failure to take reasonable steps to protect items prior to the Service.

10.5 You must inform us in writing of any claim or potential claim as soon as reasonably practicable and in any event within seven days of the date on which the relevant Services were performed. We may not be able to investigate or address claims raised outside this period.

11. Insurance

11.1 We maintain insurance cover appropriate to the nature of our business. Details of our insurance may be made available upon reasonable request.

11.2 Our insurance does not relieve you of your own responsibilities for insuring your property, nor does it extend to items not properly identified or declared at the time of service.

12. Complaints and Dispute Resolution

12.1 If you are dissatisfied with any aspect of the Services, you should notify us as soon as possible so that we can seek to resolve the issue. We may request photographs, evidence or further information to assist in investigating your complaint.

12.2 We will aim to respond to complaints promptly and fairly and may, at our discretion, offer remedies such as re-attendance, partial refund or other reasonable measures where a complaint is upheld.

12.3 These internal procedures do not affect your statutory rights under consumer legislation where applicable.

13. Data Protection and Privacy

13.1 We collect and process personal information in order to manage bookings, provide Services, take payment and communicate with you. We are committed to handling personal data in accordance with applicable data protection laws in the United Kingdom.

13.2 By making a booking, you consent to us using your contact details for operational purposes, including confirmations, reminders and follow-up communications related to the Services.

14. Force Majeure

14.1 We shall not be in breach of these Terms and Conditions nor liable for delay in performing, or failure to perform, any of our obligations if such delay or failure results from events, circumstances or causes beyond our reasonable control, including but not limited to extreme weather, accidents, traffic incidents, strikes, civil unrest, acts of government, utility failures or public health emergencies.

15. Variations to Terms

15.1 We may update or amend these Terms and Conditions from time to time to reflect changes in law, regulation, industry practice or our operational requirements. The version in force at the time of your booking will apply to that particular Service.

16. Severability

16.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, lawful and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or with the Services, shall be governed by and construed in accordance with the laws of England and Wales.

17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of the Services.

18. Entire Agreement

18.1 These Terms and Conditions, together with any written quotation or booking confirmation issued by us, constitute the entire agreement between you and us relating to the provision of the Services and supersede all previous agreements, understandings or arrangements, whether written or oral.

18.2 You acknowledge that you have not relied on any statement, promise or representation made or given by or on behalf of us that is not set out in these Terms and Conditions or in writing as part of the booking confirmation.

By proceeding with a booking and allowing our team to commence work, you confirm your acceptance of these Terms and Conditions for the provision of rubbish removal and waste collection services.
